  • Big loss for Jon Bruning in the Nebraska Supreme Court

    Earlier this week, the Nebraska Supreme Court stayed (again) the execution of Carey Dean Moore.  The problem for Bruning is that his office insisted that the State use a drug made in India as part of the death penalty chemical cocktail.  However, this Indian produced drug is illegal in the United States.  Bruning should've known this drug was illegal and not pressed forward with a case that was a sure loser.  Obviously, Bruning moved to execute Moore as some sort of political stunt aimed at boosting his flagging U.S. Senate campaign.  In response to Bruning's loss, an Omaha Republican activist is considering a ballot box challenge to six of Nebraska's seven State Supreme Court justices.  (Chief Justice Mike Heavican would be spared from this challenge, though.  Heavican is a Republican.)  Only in death penalty cases does the losing lawyer - Bruning in this case - get such a free pass.  If Bruning had been in private practice, his client would've fired him.  Instead, now that Bruning has lost, a fellow Republican has decided to attack the referees.  When Nebraska got crushed by Oklahoma St., did Tom Osborne criticize the referees who signaled all of those Cowboy touchdowns?  No.  He fired Bill Callahan and hired Bo Pelini.  If you want the State of Nebraska to win in the adversary system that are the courts, you need to elect experienced attorneys - not State Senators with ambitions for higher office.  Once again, Jon Bruning isn't ready for prime time.

    The loss for NE is in the Supreme Court justices who accepted the Moore argument about the drugs which will be used to humanely execute him.  Did Moore "humanely" kill his victims?  I don't give a flying crap where the drugs come from as long as they work...period.  Let's keep moron lawyers and judges out of these idiotic appeals and either execute the bastard or not.  Your local vet has drugs which are used to end the suffering of family pets quickly and humanely, Moore doesn't deserve any better than that or any more consideration.

    The Nebraska Supreme Court justices had no choice - the drug is illegal in the U.S.  Bruning knew that and pressed forward with the case at taxpayer expense.

    Maybe you could provide a link to the article that this came from. That way people could see that this "Republican activist", who you say is attacking the referees, actually owns one of the cab companies that one of the murder victims worked for. The same one that his mother worked for at the time of the murders, i believe.  I think he worked for the cab company around the same time these guys were killed execution style.
    You make it sound like this guy is just a bitter partisan when in all reality he has more personal interest in this case and seeing justice done than most Nebraskans.

    Besides what was Bruning supposed to do in this case?  Not defend the states position?  A lawyer is paid to represent his client, in this case the people of the State of Nebraska. He did that.  The courts disagreed with his position.  Besides the democrat  douglas county attorney disagrees that the state supreme court should be hearing the case. Does that make him incompetent too?

    And last time I checked the Judges in this state are up for election, not lifetime appointments like at the Federal level. So I don't see how a citizen excercising his democratic rights is something that should be mocked as "attacking the referees".  Isn't being engaged and atanding up against others you disagree with what this country is about?  Why should these judges not have to face public scrutiny like anyone else?

    You left out a lot of relevant information in your post Ronaldo. It was dishonest and underhanded to leave out thsese facts.

    Your post is the one that is dishonest and underhanded.  You distorted my post you said I made "this guy" sound like a "bitter partisan."  That is a deeply dishonest statement by you because I never said it or meant it.  You are the "bitter partisan" here.  I have great sympathy for Mr. Butler and his family but that doesn't change the fact that the drug used in the execution is illegal in the U.S.  The Nebraska Supreme Court had no choice but to stay the execution.  It's decision was about the rule of law. Even Mike Heavican voted to stay the execution.  Bruning knew this drug was illegal but he wasted the taxpayer's money during a state budget crisis by pressing ahead with this case.

    Really?  Then why did you refer to him Twice as a Republican and never once mention how he was connected to this crime and its victims?  How come you say that "A fellow republican has decided to attack the referees.". Why did you never state the fact that he has a personal interest in seeing justice done in this case?  Why does it matter if he is a Republican.  Apparently he was deeply affected at a personal level by this crime.

    You completely misrepresented this case by not pointing out the relationship that Mr. Butler has to this case. You used his personal tragedy and his being upset that justice has once again been denied for the victims of this crime as a political attack.. It was garbage writing and it makes future writings of yours seem suspect since you chose to not incude very pertinent information.

    Did you honestly think that the fact that he was very connected to this crime deserved no mention, but what party he is registered for needed to be mentioned twice?  Get real Ronaldo.

    I didn't call or imply that Butler is a "bitter partisan."  That is a lie.  It wasn't dishonest to leave out Butler's involvement with the case.  That was another lie. I drew the Husker analogy to say in a lighthearted manner that Butler was directing his ire at the wrong party.  My overall point is rather simple.  Bruning is an incompetent, politically motivated A.G.  Let me make another point. This place isn't the Limbaugh or the Hannity show.  Lying and name calling won't be tolerated by me.

    Why should bruning recuse himself?  That makes no sense.

    And Ronaldo, you most definitely did imply that Mr. Butler was a partisan player in the case. Fact, By calling someone a "Republican activist"  rather than stating his deep personal conection to the murders most definitely implies that they are a partisan player in the case.   Go ask any journalism prof at UNL they'd tell you the exact same thing, Fact.  By trying to lump me in with overpaid radio personalities whom I never listen too is a weak attempt to distort my credibility.
